Here’s the story of how we’ve grown and evolved from a Central Texas-based hazardous waste management business launched in 2003, to a full-service environmental, health and safety consultancy providing OSHA, environmental, and hazardous materials compliance services to clients throughout the country.

The story actually involves two different companies: Berg Environmental Services, Inc. (“BES”) and Berg Compliance Solutions, LLC (“BCS”). Berg Environmental Services, Inc. was launched on August 1st, 2003 to help Central Texas companies manage industrial and hazardous waste management issues. 14 years later, BES is still going strong and in February of 2013 helped launch a spinoff company called Berg Compliance Solutions, LLC which specializes in helping small manufacturing, construction, energy and industrial services companies manage EHS compliance issues.

We focus almost entirely on working with small companies (less than 250 employees) and that’s because small companies are most likely to struggle with managing their EHS compliance obligations, and thus most vulnerable to associated risks such as regulatory fines & penalties, serious workplace injuries, higher insurance costs, etc.

Small companies rarely have the resources to staff a full-time, experienced environmental, health and safety manager and therefore often task a staff manager (HR, Operations, Maintenance) with compliance responsibilities. We’ve seen this scenario play out over and over again throughout the years, and it almost never works and here’s why:

1) The manager rarely, if ever, has the technical knowledge and experience to understand & manage the regulations, and

2) They can rarely allocate enough time to compliance because their primary role with the company has a direct impact on the bottom line.

This situation can lead to very real and significant consequences. Unfortunately, we’ve  seen several clients get in major trouble with regulators over the years, as well as having serious workplace injuries.

I (the owner of BES and BCS) was given first-hand exposure to this dilemma when I found two separate energy services companies several years ago. Both companies were small and exposed our employees to significant health and safety hazards on a regular basis and so I was always very focused and determined to manage our OSHA compliance obligations and keeping our employees safe. But as I learned the hard way, recognizing the importance of managing our compliance obligations was one thing, but successfully managing those requirements turned out to be quite another.  I was always worried about getting the call that someone had been hurt, and always wondered if our staff was following our policies and procedures and working safely. I’d say we did a better than most of our small competitors, but there’s no doubt that we could have done much better.

These combined experiences give us a unique perspective on the challenges faced by small companies when trying to manage EHS compliance and were the inspiration for launching Berg Compliance Solutions in 2013. We offer on outsourced EHS compliance solution called Assured Compliance, where our team of experts essentially become the environmental, health and safety department for our clients. It’s a turn-key service where we help our clients implement and manage all applicable EHS programs, train employees, conduct regular inspections and ensure that our clients achieve and maintain compliance. It’s a cost-effective, fixed fee structured contract that typically costs less than ½ the salary of a full-time EHS employee. The model has proven to be very successful, proven by our significant year to year growth and 95%+ renewal rates. We started out with 1 part-time consultant, and now have a complete team of experts who can help our clients manage virtually any EHS compliance challenge.

Although Assured Compliance is our core service and purpose, we offer a wide variety of other compliance services including EHS audits, safety and environmental training, industrial hygiene surveys, written program development and hazardous waste management services. And yes, we work with large companies too!
