Intellectual Property Policy

INDUSTRYARCHIVE.ORG reserves the right to  terminate the account of any user who repeatedly infringes or is  repeatedly charged with infringing the copyright or intellectual  property of others.

1. Copyright Infringement

In accordance  with the terms of the Digital Millennium Copyright Act of 1998, any  reports of alleged copyright infringement should be delivered to the  INDUSTRYARCHIVE.ORG Designated Copyright Agent.

If you send us a request to take down User Content that infringes upon your copyright, your request should include:

  • Identification of the copyrighted work that you believe has been infringed, 
  • A description of the User Content you believe infringes upon your  copyright and a short explanation of how the User Content infringes your  rights. 
  • The Site URL that contains the infringing User Content. 
  • Your contact information (address, telephone number and/or email address). 
  • The following statements:
    • "I hereby state that I have a good faith belief that the disputed use  of the copyrighted material is not authorized by the copyright owner or  its agent." 
    • "I hereby state that the information in this complain  is accurate and, under penalty of perjury, that I am the owner, or  authorized to act on behalf of the owner, of the copyright or of an  exclusive right under the copyright that is allegedly infringed." 
  • Your full legal name and physical or electronic signature.

2. Other Intellectual Property Infringement

If  you send us a request to take down User Content that infringes upon any  other intellectual property rights (e.g. trademarks, patents, trade  secrets, rights of publicity, etc.), your complaint or request should  include (a) the intellectual property you own that is being infringed;  (b) a description of the User Content you believe infringes upon your  intellectual property; (c) the Site URL that contains the infringing  User Content, and (d) a short explanation of how the User Content  infringes your rights. Any such complaints should be sent to  issues@IndustryArchive.Org.com

3. Procedure for Reporting False User Content

Any  requests to take down User Content that is false should be sent to  issues@IndustryArchive.Org.com. Any such complaints or requests should  include your name, your mailing address, your telephone number and your  e-mail address.

4. Fake Profiles

If someone has created a  profile in which he or she pretends to be you, and you send us a request  to take down that profile, please be sure that you have included the  URL of your profile and the fake profile, and that you clearly indicate  which profile is the fake profile. Any such complaints should be sent to  issues@IndustryArchive.Org.com

5. Next Steps

Once we receive a  complaint, we will make best efforts to review the complaint as soon as  possible. If you have provided us all of the information above, we will  promptly remove or block access to the User Content or the fake  profile, and will send a notice to the other INDUSTRYARCHIVE.ORG user indicating that we have done so. We will terminate the accounts of any repeat infringers at our discretion.

6. Counter Notice

If  we send you a notice that we’ve removed your User Content from the Site  because it is fake or because it infringes upon another party’s  intellectual property rights, and you believe that we acted as a result  of misidentification or error, you can lodge a Counter Notice by  e-mailing us at issues@IndustryArchive.Org.com.

Any Counter Notice should include:

  • Your name, address, telephone number and e-mail address.
  • An identification of the material that we took down.
  • A statement that you have a good faith belief that the material was removed as a result of mistake or misidentification.
  • A statement that you consent to the jurisdiction of Federal District  Court for the judicial district in which you reside (or, if you reside  outside the United States, the jurisdiction of the federal court in New  York, New York), and that you will accept service of process from the  complaining party or its agent in the event that a law suit is filed  against you relating to such user content.
  • Your physical or electronic signature. If we receive such a Counter  Notice, we may notify the original complaining party and provide them  with a copy of the Counter Notice. If the original complaining party  does not file a law suit or other legal action within 10 business days  of receiving the Counter Notice, we will restore the User Content  removed from your profile.° Your name, address, telephone number and  e-mail address.
  • An identification of the material.
  • A statement that you have a good faith belief that the material was removed as a result of mistake or misidentification.
  • A statement that you consent to the jurisdiction of Federal District  Court for the judicial district in which you reside (or, if you reside  outside the United States, the jurisdiction of the federal court in New  York, New York), and that you will accept service of process from the  complaining party or its agent in the event that a law suit is filed  against you relating to such user content.
  • Your physical or electronic signature.

If  we receive such a Counter Notice, we may notify the original  complaining party and provide them with a copy of the Counter Notice. If  the original complaining party does not file a law suit or other legal  action within 10 business days of receiving the Counter Notice, we will  restore the User Content removed from your profile.
